Terms of Service

Welcome to MaSemaine! These Terms of Service («Terms») govern your access to and use of the MaSemaine web application, accessible at masemaine.ca («Service»), operated by MaSemaine («we», «our», or «MaSemaine»).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not accept these Terms, you may not use the Service.

1. Description of the Service

MaSemaine is a meal planning application that allows you to:

• Create, import and manage your recipes
• Plan your meals on a weekly basis
• Automatically generate grocery lists
• Use artificial intelligence to generate recipe suggestions
• Share your account with your family by sharing your login credentials
• Browse grocery flyer deals

2. Account Creation and Eligibility

2.1 Eligibility

To use the Service, you must be at least 14 years old. If you are between 14 and 18 years old, you declare that you have obtained the consent of a parent or legal guardian.

2.2 Account Information

You must provide accurate, complete and up-to-date information when creating your account. You are responsible for maintaining the confidentiality of your password and for all activity carried out under your account.

2.3 Account Security

You must notify us immediately of any unauthorized use of your account or any other security breach. We will not be liable for losses resulting from unauthorized use of your account.

3. Subscriptions and Payments

3.1 Subscription Plans

MaSemaine offers different subscription plans: a Free plan with limited features, and paid plans (Basic and Premium). The features and limits of each plan are described on our pricing page.

3.2 Free Plan

The free plan includes 14 AI credits per month, allowing new users to discover the application's features. To access more credits and advanced features, you can subscribe to a paid plan.

3.3 Billing

Subscriptions are billed in advance on a monthly or annual basis, depending on the chosen plan. Payments are processed securely by Stripe. By subscribing to a paid plan, you authorize MaSemaine to charge your registered payment method.

3.4 Automatic Renewal

Subscriptions renew automatically at the end of each billing period, unless you cancel before the renewal date. You can cancel your subscription at any time from your account settings.

3.5 Right of Resolution and Refunds

In accordance with the Quebec Consumer Protection Act , you may resolve the contract within 14 days of your first payment, without having to provide a reason. To exercise this right, send your request to hello@masemaine.ca.

Beyond this period, payments are generally non-refundable, except in the following cases:

• Major technical issue rendering the Service unusable
• Exceptional circumstances, evaluated on a case-by-case basis

3.6 Price Changes

We reserve the right to modify our prices. Any price change will be communicated at least 30 days in advance and will only apply to the next billing period.

4. User Content

4.1 Content Ownership

You retain all intellectual property rights over the content you create on MaSemaine (recipes, meal plans, images you upload). We do not claim any ownership rights over your content.

4.2 License Granted to MaSemaine

By posting content on the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, store and display your content for the purpose of providing and improving the Service. This license ends when you delete your content or your account.

4.3 Content Responsibility

You are solely responsible for the content you post. You represent and warrant that:

• You have the right to post this content
• The content does not violate the rights of others
• The content does not contain illegal, defamatory or offensive material

4.4 AI-Generated Content

Recipes and suggestions generated by our artificial intelligence system are provided for informational purposes only. We do not guarantee the nutritional accuracy, absence of allergens, or suitability of generated recipes for your specific needs. It is your responsibility to verify ingredients and instructions before preparing a recipe.

5. Account Sharing

5.1 How It Works

You may share your MaSemaine account with your partner or family by sharing your login credentials. All account data (recipes, meal plans, grocery lists) is then accessible to anyone who is logged in.

5.2 Shared Data

When you share your credentials, the connected persons have access to the same data:

• Recipes (created and imported)
• Weekly meal plans
• Grocery lists

You are responsible for the use of your account by the persons with whom you share your credentials.

5.3 Simultaneous Login

Multiple people can be logged in at the same time on different devices with the same account.

6. Acceptable Use

6.1 Prohibited Uses

You agree not to:

• Use the Service for illegal purposes
• Attempt to access unauthorized accounts or systems
• Circumvent security measures or usage limitations
• Collect or extract data from other users without authorization
• Use bots, scripts or other automated means to access the Service
• Resell, redistribute or commercially exploit the Service without authorization
• Post content that incites hatred, violence or discrimination
• Impersonate another person or entity

6.2 Usage Limits

The Service has usage limits (number of AI generations per month, storage space, etc.) that vary according to your subscription plan. Any attempt to circumvent these limits may result in the suspension or termination of your account.

7. Intellectual Property

The Service, including its source code, design, logos, trademarks and all other content created by MaSemaine, is protected by intellectual property laws. You are not authorized to copy, modify, distribute or create derivative works without our prior written authorization.

Some recipe images come from Pexels and are used in accordance with their license. Appropriate attributions are provided where required.

8. Service Availability

We strive to keep the Service available 24 hours a day, 7 days a week. However, we do not guarantee uninterrupted availability. The Service may be temporarily unavailable for:

• Scheduled maintenance (we will attempt to notify you in advance)
• Updates and improvements
• Unforeseen technical issues
• Events beyond our control (hosting outages, natural disasters, etc.)

9. Limitation of Liability

9.1 Disclaimer of Warranties

To the fullest extent permitted by the Quebec Consumer Protection Act , the Service is provided «as is» and «as available». We make no express or implied warranties regarding the Service, including but not limited to warranties of merchantability, fitness for a particular purpose or non-infringement, except where such warranties cannot be excluded under applicable law.

9.2 Limitation of Damages

To the fullest extent permitted by applicable law, MaSemaine shall not be liable for:

• Indirect, incidental, special, consequential or punitive damages
• Loss of profits, revenue, data or business opportunities
• Damages resulting from your use of or inability to use the Service

Our total liability to you shall not exceed the amount you have paid us in the past 12 months.

9.3 Nutritional Information

The nutritional information and recipes provided do not constitute medical or dietary advice. If you have food allergies, medical conditions or specific dietary needs, consult a qualified health professional.

10. Indemnification

You agree to indemnify, defend and hold harmless MaSemaine, its officers, employees and agents from any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising from or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of the rights of a third party
• The content you post on the Service

This indemnification clause does not apply where MaSemaine has committed gross or intentional misconduct, nor where its application would be contrary to the Quebec Consumer Protection Act .

11. Termination

11.1 By You

You may delete your account at any time from your account settings. Deleting your account will result in the permanent deletion of your data within 30 days.

11.2 By Us

We may suspend or terminate your access to the Service immediately, without notice, if you:

• Violate these Terms
• Use the Service in a fraudulent or illegal manner
• Fail to pay subscription fees due
• Endanger the security of the Service or other users

11.3 Effects of Termination

Upon termination, your right to use the Service ceases immediately. The sections of these Terms that by their nature should survive termination will remain in effect.

12. Modifications to the Terms

We reserve the right to modify these Terms at any time. In the event of significant changes, we will notify you by email or by a visible notice in the application at least 30 days before the changes take effect.

Your continued use of the Service after the changes take effect constitutes your acceptance of the new Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the province of Quebec and the applicable federal laws of Canada. Any dispute arising from or related to these Terms will be subject to the exclusive jurisdiction of the courts of the province of Quebec.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MaSemaine regarding the Service.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full effect.

14.3 Waiver

Failure to exercise a right provided for in these Terms does not constitute a waiver of that right.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in the context of a merger, acquisition or asset sale. In the event of an assignment, we will notify you by email at least 30 days in advance.
